PRESIDEN NOMOR 20 TAHUN 2018 TENTANG PENGGUNAAN TENAGA KERJA ASING
Abstract
This research explains the interest of Indonesian expatriate policies in 2018. The purpose of this legal research is to know how the government policy in recruiting foreign workers according to the Law to know how the policy of foreign workers employment in Indonesian and to know the obstacles in supervising foreign workers and find out the implication of the existence of foreign workers in relation with the need of professional experts and the need of technologies that can support working process.
This research is a qualitative research using documents from books, international and national journals, working papers from study centers, government regulations, and websites to analyze this phenomenon. To describe the phenomenon of the theory of neorealism, human security and the decision-making process are used.
These findings indicate a gap between the proposed regulations and the fact of dissatisfaction and protests from local workers. Local workers think that expats have taken over their opportunities. These expatriates were hired as a consequence of the influx of investment in Indonesia to support Indonesia to become a developed country. The need for foreign investment makes the Indonesian government tolerate abuses by expatriates. The national interest to improve welfare is the main goal with consequences.
