Abstract

An agreement is a legal relationship between two parties based on which one
party has the right to demand something from the other party. The Consumer
Financing Agreement is a reciprocal agreement in which one party (financial
institution) provides its achievements in the form of financing (payment of funds)
for the procurement of certain goods needed by the other party (consumers) with
reciprocal achievements in the form of installment payments for the value of the
financing provided. provided with interest and other fees. In practice, the debtor
violates Article 3 paragraph 4, the debtor does not make installment payments
according to the installment due date. But in reality, there are also many debtors
who do not pay on the date specified in the agreement in Article 3 paragraph 4
and do not even pay at all, this is also called default. The purpose of writing this
thesis: First, to find out the form of default in the implementation of motor vehicle
financing agreements at PT. Adira Dinamika Multi Finance Branch Sudirman
Pekanbaru. Second, to find out the settlement of defaults in the implementation of
motor vehicle financing agreements at PT. Adira Dinamika Multi Finance Branch
Sudirman Pekanbaru.
This type of research is sociological/empirical, namely a research approach that
studies the influence of society on law, the extent to which the symptoms that exist
in society can influence law and vice versa and departs from the paradigm of
empirical science.
The research results show that creditors should be more selective and provide
more convenience to consumers in granting credit, so that finance companies do
not experience losses due to consumers who default, as well as debtors can easily
get the vehicle they want and according to their abilities and the government
should supervise and consumer protection, because consumers in this case are in
a weak position. So it is necessary to supervise business activities in the field of
goods and services
