Abstract

The transfer of land rights is to transfer land rights owned to other people, which can be
done by: buying and selling, swapping, grants and gifts according to custom. cases that
occurred related to the transfer of land rights, one of the disputes that occurred in Padang
Pariaman Regency, District VII Koto Sungai Sariak. where inheritance occurs patrilineally,
which should be in accordance with customary law that exists matrilineally. Therefore, the
purpose of writing this thesis is: first, to find out about the process of transferring land rights
from the Piliang tribe to the Jambak tribe due to marital ties in review from Minangkabau
customary law in District VII Koto Sungai Sariak, Padang Pariaman Regency. Second, to find
out the dispute resolution process in the Transfer of Land Rights of the Piliang Tribe to the
Jambak Tribe Due to Marriage Ties In Review from Minangkabau Customary Law in District
VII Koto Sungai Sariak, Padang Pariaman Regency.
The research method in this thesis uses a type of sociological legal research, namely
research on the effectiveness of laws that live in society. The nature of this thesis research is
researchdescriptivewhich describes systematically, the facts and characteristics of the object
studied appropriately. The data source used is the data sourcefirst, seconds andtertiary, the
data collection technique in this study was by interview method, and literature review, then
after the data was collected, it was then analyzed to draw conclusions.
Based on the research results, conclusions can be drawnFirst that the transfer of
customary land rights from the Piliang tribe to the Jambak tribe is a gift or gift as a condition
for marriage between Gandui and Utti Rijjah which is granted based on a decision of the
Piliang tribal deliberation, second namely Settlement of disputes between the Jambak tribe and
the Piliang tribe resolved based on customary provisions in force in Minang Kabau, peace
through deliberations to reach a consensus, the form of peace decisions is that the land belongs
to the Jambak tribe and both parties agree to maintain security and order on the land and must
notify every descendant of the two parties who carry out the deliberations.
