POLITIK HUKUM PENGATURAN PERLINDUNGAN HUKUM TERHADAP PEKERJA LEPAS ATAU FREELANCER DI INDONESIA DALAM UPAYA MENJAMIN KEPASTIAN HUKUM BAGI PEKERJA LEPAS ATAU FREELANCER

Abstract

Work is a requirement that must be owned by someone to meet their needs. Forms or
types of workers are known by various names and titles, such as freelancers. The legal shelter
of this freelancer joins the provisions regarding PKWT because of its characteristics which
are completed once, this freelancer is included in the classification of work with a work
agreement for a certain time.
This research is a normative legal research. This is marked in the literature research
that takes quotations from several reading sources that have something to do with the problem
to be studied. This study uses secondary data sources consisting of primary, secondary and
tertiary book materials. This study also used qualitative data analysis and produced
descriptive data.
From the results of the research and discussion conducted, it can be concluded that the
regulation regarding legal protection for freelancers has actually been regulated for a long
time, but it is incorporated into the type of work with a Specific Time Agreement (PKWT) so
that loopholes are still often found. interpreted differently and even deviate from the
provisions. This legal politics regarding PKWT tends to provide convenience for companies
that will employ casual workers. Considering that the development of freelancers or
freelancers is increasingly showing high numbers, the provisions that regulate them must also
be paid more attention to. The gaps which can then be misinterpreted related to the
classification of freelance workers in this PKWT must be clarified because they are the
foundation for determining which policies will be used for freelancers. This affirmation and
refinement is necessary in order to reduce or even eliminate gaps that can be distorted in the
framework of industrial relations harmony.
