ANALISIS YURIDIS PERUBAHAN TATA PEMERINTAHAN DESA DAN KELURAHAN DALAM PERSPEKTIFOTONOMI DAERAH
Abstract
Changing the status of a village to a sub-district is a government policy or effort to form a new
sub-district with the aim of achieving effectiveness and efficiency in services to the community. This
was carried out in order to respond to and accommodate the development and complexity of
community service interests, especially at the sub-district level, including within the Bandung
Regency Regional Government. The results of the study show that several villages are eligible to turn
into sub-districts, namely Pamekaran Village, Sadu Village and Soreang Village. Meanwhile, other
villages are not yet eligible to become sub-districts because there are several conditions that have
not been met, including the area being less than large. Based on these problems, the author is
interested in knowing the mechanism for changing the status of villages to sub-districts in the
perspective of regional autonomy and to know the ideal concept of the mechanism for changing the
status of villages and sub-districts as autonomous regions.
This type of research is classified as normative legal research. In normative legal research, the
data source is secondary data consisting of primary legal materials, secondary legal materials and
tertiary legal materials. Collecting data on normative legal research uses data collection techniques
from a literature study. The data obtained through a literature study will be analyzed qualitatively. In
drawing conclusions the author uses a deductive thinking method, namely a way of thinking that
draws conclusions from a general statement or proposition to a specific statement.
Based on the research results, it can be understood that the mechanism for changing the status
of a village to a sub-district in the perspective of regional autonomy in Indonesia is regulated in Law
Number 32 of 2004 in conjunction with Law Number 15 of 2019 concerning the Second Amendment
to Law Number 23 of 2014 concerning Regional Government. Changing the status of a village to a
sub-district from a regional autonomy perspective is a process that involves various stages and
procedures in accordance with applicable regulations. It is important to involve active community
participation in this process so that decisions taken can reflect the aspirations and needs of local
communities. The ideal concept for changing the status of a village to a sub-district includes
Feasibility Evaluation, Consultation and Participation, Administrative Preparation, Drafting
Regulations, Strengthening Human Resources, Improving Public Services, Inter-Governmental
Coordination, Financial Management, Evaluation and Adjustment. Changing the status of a village
to a sub-district is a significant step and must be done carefully and based on good considerations.
Community involvement and intergovernmental coordination are important factors that must be
considered in this change process.
