ANALISIS YURIDIS HAK RECALL PARTAI POLITIK DALAM PERSPEKTIF TEORI KEDAULATAN RAKYAT

Abstract

In general, political parties are pillars of democracy. If this pillar is
no longer trusted by the people, then it is a serious threat to the sustainability of
democracy in Indonesia. In fact, Indonesia tends to adopt a diversified model in
which members of the House of Representatives are representatives of political
parties. The existence of recall rights that are used by political parties against
members of the House of Representatives who come from the political party
concerned strengthens this. From the recall incident that happened to several
members of the People's Representative Council, it can be seen that the
absolutism of political parties towards members of the people's elected council.
The purpose of writing this thesis, namely; First, to find out the recall rights of
political parties in the perspective of the theory of popular sovereignty in
Indonesia. second, the ideal concept of a political party that is in line with the
principle of popular sovereignty in Indonesia.
This type of research can be classified in the type of normative
research, because in this study the authors conducted research by examining
library materials or secondary data. In this study, the data sources used were
primary data, secondary data and tertiary data. The data collection technique in
this study was through reading legal journals, books related to the issues in the
research.
From the results of the research problem there are two main things
that can be concluded. First, in the recall rights exercised by political parties with
immeasurable reasons. Second, recall rights granted to political parties are not in
line with the principle of popular sovereignty. The author's suggestion, first, is
that in terms of recall rights, there is no need for absolutism to political parties
but must move towards people's sovereignty. Second, the author feels the need to
recommend to political parties as full holders of recall rights granted by the law
to form a special body in providing considerations regarding the recall of
members of the Council by directly involving people's participation as an element
of people's sovereignty which consists of intellectuals and political observer.
