Abstract
Termination of employment is part of an employment relationship which was originally a legal relationship within the scope of private law because it only concerns the individual legal relationship between the worker/laborer and the entrepreneur. Termination of employment by PT. Bormindo Nusantara against employees is carried out unilaterally without prior notification by the company and layoffs of contract employees are not in accordance with the agreed contract agreement. Some of the workers whose employment relationship was terminated made a defense in the form of a complaint to the Bengkalis Regency Manpower and Transmigration Office as a mediating agency for solving layoffs. The formulation of the problem in this study is how the role of the Bengkalis Regency Manpower and Transmigration Office in solving the problem of termination of employment by PT. Bormindo Nusantara in 2018-2019?
This study aims to describe and analyze the role of the Bengkalis Regency Manpower and Transmigration Office in Solving the Problem of Termination of Employment by PT. Bormindo Nusantara 2018-2019. This research is a descriptive research using a qualitative approach. Data collection techniques in this study using interview techniques, observation and documentation, data analysis used is qualitative analysis.
The results of this study are the implementation of the role of the Bengkalis Regency Manpower and Transmigration Office in solving the problem of termination of employment (PHK) carried out by PT. Bormindo Nusantara 2018-2019 is in accordance with the applicable regulations and Law No. 2 of 2004 concerning PPHI. However, there are still obstacles in carrying out their roles, such as a lack of mediators in resolving layoffs, lack of facilities and budget in carrying out operational activities and guidance to companies in anticipation of layoffs and complaints to the agency, and in conducting mediation sessions there is a reluctance of the parties to negotiate or be present at the hearing. mediation. This happened when the pre-conditions led to negotiations, especially from the company.
